Hosting and Web Services Terms of Service

This document sets the conditions under which Archetype Solutions LLC provides hosting, domain management, and web services.

1. Scope of Hosting Services

  • Availability: Reasonable commercial effort for 99.9% uptime.
  • Resources: Clients must respect contracted limits (e.g., 5GB). Excessive use may require a plan upgrade.
  • Backups: The final responsibility for keeping local copies of files and emails rests with the client.

2. Domain and DNS Management

  • Ownership: The domain is the client’s property. Archetype is not responsible for domain loss due to non-payment to external registrars.

3. Acceptable Use and Indemnification

  • Content: Prohibited use of illegal content, spam, or copyright-infringing material.
  • Indemnification: The Client agrees to defend and indemnify Archetype against any legal claims arising from the content or use of the website by the Client.

4. Security and Maintenance

It is the client’s responsibility to keep their CMS (WordPress, plugins, etc.) updated to avoid vulnerabilities, unless a specific maintenance plan is contracted.

5. Payments, Cancellation, and Suspension

  • Prepayment: Services are paid in advance.
  • Suspension: Service is suspended after a 5-day grace period for non-payment; after 30 days, content may be deleted.
  • Cancellation: Clients must notify their intention to cancel or migrate at least 30 days in advance.

7. Limitation of Liability

The maximum total liability is limited to the amount paid by the client for the hosting service during the last year.
